Swazi Host HRM & Payroll System – Terms and Conditions

Welcome to Swazi Host HRM & Payroll System (“the Service”). These Terms and Conditions (“Terms”) govern your use of our cloud-based Human Resource Management (HRM) and Payroll software provided by Swazi Host (Pty) Ltd, a company registered in Eswatini.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Account Registration and Access

1.1. You must register for an account to use the Service. You agree to provide accurate, current, and complete information.

1.2. You are responsible for safeguarding your login credentials. Swazi Host is not liable for any unauthorized access due to lost or compromised credentials.

2. Use of the Service

2.1. The Service is intended solely for lawful business purposes related to human resource and payroll management.

2.2. You agree not to:

• Use the platform for illegal, fraudulent, or abusive purposes;

• Interfere with or disrupt the platform’s functionality;

• Attempt to access data or accounts you are not authorized to view.

3. Data Privacy and Confidentiality

3.1. All personal and organizational data entered into the system remains your property.

3.2. Swazi Host will not disclose your data to third parties except as required by law or with your written consent.

3.3. Data is stored securely and handled in accordance with local data protection regulations.

4. Subscription, Payments, and Refunds

4.1. Access to premium features requires a valid subscription. Pricing is outlined on our website or agreed upon in writing.

4.2. Payments must be made via approved payment methods on or before the due date.

4.3. Late payments may result in temporary suspension of services.

4.4. Refunds are only issued if the Service fails to meet advertised features and no resolution can be reached within 14 business days of reporting the issue.

5. System Availability and Maintenance

5.1. While Swazi Host aims for 99.9% uptime, we do not guarantee uninterrupted availability.

5.2. Scheduled maintenance or emergency downtime will be communicated in advance where possible.

6. Termination and Suspension

6.1. You may terminate your account at any time with written notice.

6.2. Swazi Host may suspend or terminate your access for:

• Breach of these Terms,

• Non-payment of fees,

• Suspected misuse or security threat.

6.3. Upon termination, data will be retained for 30 days before permanent deletion unless otherwise requested in writing.

7. Intellectual Property

7.1. All software, content, and trademarks on the platform remain the intellectual property of Swazi Host.

7.2. You may not copy, reverse-engineer, or resell any part of the Service without prior written permission.

8. Limitation of Liability

8.1. Swazi Host is not liable for indirect, incidental, or consequential damages arising from the use or inability to use the Service.

8.2. Our total liability is limited to the fees paid by you in the 3 months preceding the incident.

9. Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the Kingdom of Eswatini. Disputes shall be resolved through arbitration or courts of competent jurisdiction in Mbabane.

10. Changes to These Terms

Swazi Host reserves the right to update or modify these Terms at any time. Changes will be posted on our website and will become effective upon posting. Continued use of the Service constitutes acceptance of the new Terms.
